WAIVER AND RELEASE

 

I understand there are certain risks of physical injury––including, but not limited to, drowning and serious disability––that may occur while engaging in recreational water sports. Such sports include the use of kayaks, canoes, stand-up paddle boards, paddle boats and inner tubes, all of which are rented out by North Fork Outfitting LLC.

 

In consideration for being allowed to participate, I agree to assume the full risk for any injuries, damages or losses which may be sustained as a result of Participant’s participation in the sports activities made available by North Fork Outfitting and the use of its equipment, including the shuttle van.

 

Therefore, I fully waive and release any and all liability claims against North Fork Outfitting LLC, and the City of Norfolk, Nebraska, and their respective officers,  agents, employees and volunteers, and hold them harmless from any and all claims for  personal injuries, damages to personal property, or other losses of any kind while participating  in Outfitter’s water sport activities and use of their equipment and the Skyview Park facilities, save and except any actionable negligence on the part of North Fork Outfitting LLC.

 

I agree that Participant shall follow all rules, regulations and instructions of North Fork Outfitting, and shall wear the floatation vest  provided, even if a good swimmer.

 

If checked here _____, I permit the use of Participant’s image in photos or videos that may be taken during the day’s activities for publicity, advertising or other promotional purposes.
